Poe API Terms

These Poe API Terms (“API Terms”) set forth the terms and conditions of your use of the Poe APIs (“Earnings Program”). By using the Poe APIs, you consent to these API Terms.

Use of Poe and its APIs is also subject to the Poe Terms of Service (collectively with the API Terms, the “Terms”), as applicable, and our Privacy Policy. As used in these Terms, “API” means any application programming interface made available by Poe and any related data provided through the API. All capitalized terms in these API Terms have the same meaning as set forth in the Terms of Service, except as otherwise noted.

In the event of a conflict between the API Terms and the Poe Terms of Service, these API Terms shall control.


1. Documentation

In creating Your Bot for Poe, you must adhere to our Developer Documentation and any other documentation we make available (“Documentation”).

2. Policies

You must adhere to our policies, including our Usage Guidelines, and any applicable law or regulation at all times. Further, if you use the Bot Query API please review and understand the applicable restrictions on use in Section 4b below.

3. Credentials

You will use any developer credentials we assign to you solely with Your Bot and the applicable APIs (and will not permit or enable any other bot to use them) and will maintain the confidentiality of any developer credentials or API keys we issue to you. You will be solely responsible for all bots that are developed using your developer credentials.

4. License

a. License to You

Subject to your compliance with these Terms, we grant you a limited, non-exclusive non-transferable, non-sublicensable, revocable license to access the APIs and Documentation solely as needed to develop, integrate, and operate Your Bot on the Poe platform. We reserve all rights not expressly granted and you may only access APIs and Documentation as stated herein.

b. License Restrictions

You will not (nor permit or enable others to): (a) use the APIs other than permitted by these Terms, the Documentation or our policies, (b) modify, create derivative works, copy, reproduce, redistribute, rent, lease, sell, syndicate or otherwise provide access to the APIs; (c) reverse engineer or otherwise derive source code, trade secrets, or know-how from the APIs; (d) submit any viruses, worms, Trojan horses, malicious prompts, or other harmful code to Poe via the APIs, (e) attempt to interfere with the proper working of the APIs or Poe or compromise their integrity or security; or (f) exceed any API rate, call, or other usage limits we set in our sole discretion (including as set forth in the Documentation) or that we believe constitutes excessive or abusive usage.

Further, if you use the Bot Query API you will (i) not use the Bot Query API or any data received through it to train or develop foundation models or other large language models, and (ii) use the Bot Query API and any data received through it solely in connection with Your Bot on Poe.

c. License to Us

We may use Your Content and Your Bots to provide and improve Poe, including:

  • Making available Your Bots for others to use and interact with within Poe
  • Marketing and promoting Your Bots to others
  • Providing any content provided by Your Bots to third party services that help to run Poe, provided we have a reasonable need to provide such content to a third party service.
  • Displaying Your Content and Your Bots to others if you use the sharing features in Poe
  • Understanding the use of Your Bot to generally improve the Poe services

We may also need to use or disclose Your Content or Your Bots to comply with applicable laws, enforce these Terms and our policies, and to detect and prevent fraud, security, or technical issues.

We will not (i) use any content provided by Your Bot to train a large language model, or (ii) provide any content provided by Your Bot to a third-party service unless we have a contractual agreement in place with such service restricting their use of such content.

By using the Poe APIs, you grant us a worldwide, non-exclusive, royalty-free, and transferable license to use Your Content and Your Bots as stated above.

d. Trademarks

We grant you a non-exclusive, non-transferable, non-sublicensable (except to affiliates) license to use our name, logo, and other trademarks solely to promote Your Bot. You may not imply that we created, support, or endorse Your Bot without our prior written consent. All goodwill derived from your use of Poe or Quora trademarks will inure to our sole benefit. Use of the Poe and Quora trademarks is subject to our branding guidelines.

You grant us a non-exclusive, non-transferable, non-sublicensable (except to affiliates) license to use your name, logo, and other trademarks solely to display and make available Your Bot within Poe, promote Your Bot and Poe. We may not imply that you support or endorse Poe without your prior written consent. All goodwill derived from our use of your trademarks will inure to your sole benefit. Use of your trademarks is subject to any branding guidelines you provide to us.

e. Feedback

If you provide feedback or suggestions on our APIs, Poe, or the bot creator program, we may freely use that feedback without any obligation to you.

5. Privacy

To the extent any user data you receive through the APIs contains personal data, you will: (a) comply with all applicable data protection laws and only use such personal data in accordance with the Poe Privacy Policy, (b) promptly delete the personal data when requested by a user (or by us on behalf of a user or their authorized agent) or as required by law,(c) implement strong technical and organizational security measures to protect such personal data from unauthorized use, access, or disclosure, (d) notify us within 48 hours in the event of a data breach that involves Poe user personal data and take appropriate steps to mitigate, and (e) not sell user personal data. You and Poe will operate as independent data controllers.

6. Right to Review

We reserve the right to review Your Bot and use of our APIs to ensure quality, improve the APIs and verify your compliance with these Terms. You agree to respond promptly to our requests to verify and audit your compliance with these Terms. We may remove Your Bot from Poe or suspend access to the APIs at any time for any reason.

You also represent and warrant that you have obtained and will maintain all necessary rights to grant us the licenses, permissions, and other rights in the Terms (including those in Sections 4) and to operate Your Bot (including to display, distribute, and provide all information, data, and other content therein).

7. Confidentiality

Our confidential information includes any materials, communications, and information that are marked or designated confidential or that would normally be considered confidential under the circumstances (including any nonpublic information). This may include, our communications to you, our APIs, your participation in feedback surveys, testing and experiments and any use of or APIs we make available to you that are not generally publicly available. If you receive any of our confidential information, then you (i) will keep it confidential using no less than reasonable care to protect it, (ii) will only use it as necessary for your permitted use of the APIs under these Terms and to provide us feedback, and (iii) will not disclose it to any third party without our prior written consent, except to the extent required by law with reasonable prior notice to us unless prohibited by court order.

8. Termination

You or we may terminate these Terms at any time by providing the other party with 30 days prior written notice of termination.

You or we may also terminate these Terms immediately if required to do so by law, or if either of us determines that continuing under these Terms could result in legal or business liability or cause harm to our products, services, reputation or users. We may also terminate these Terms or suspend access to the APIs immediately if you breach these Terms or our policies.

Upon termination, you will cease using the APIs and Your Bot will no longer be accessible by users on the Poe platform. When the Terms come to an end, those terms that by their nature are intended to continue indefinitely will continue to apply, including Sections 3e, 5, 7, 9, 10 and 11.

9. Disclaimers & Limitation of Liability

Section 8 of the Quora Platform Terms of Service is incorporated herein by reference, except that Section 8(e) of the Quora Platform Terms of Service is replaced with the following: WITHOUT LIMITING THE FOREGOING, QUORA’S MAXIMUM AGGREGATE LIABILITY TO YOU FOR LOSSES OR DAMAGES THAT YOU SUFFER RELATED TO OR ARISING OUT OF YOUR USE OF THE APIs or POE SERVICES OR THESE TERMS IS LIMITED TO $100.

POE, ITS FEATURES, SERVICES AND APIs ARE PROVIDED “AS IS.” WE CANNOT GUARANTEE THE AVAILABILITY OF ANY BOTS, APIs, FEATURES OR SERVICE OF POE OR AVAILABLE THROUGH POE. WHILE WE ARE CONTINUING TO DEVELOP NEW FEATURES, ADD BOTS AND IMPROVE POE, WE MAY, WITHOUT NOTICE TO YOU, ADD OR REMOVE FEATURES OR BOTS, LIMIT USE OR AVAILABILITY OF FEATURES, BOTS OR APIs ENTIRELY IF THEY CREATE RISK TO QUORA, USERS OF POE, THIRD PARTIES POWERING THE BOTS, NO LONGER MAKE SENSE FROM A BUSINESS PERSPECTIVE OR FOR ANY REASON IN OUR SOLE DISCRETION. WE ALSO CANNOT GUARANTEE THAT YOUR USE OF POE OR ITS APIs WILL BE ERROR FREE, DISRUPTED OR THAT YOU WILL NOT EXPERIENCE SERVICE OUTAGES. WE ARE NOT LIABLE FOR ANY ERRORS, DISRUPTIONS OR SERVICE OUTAGES THAT MAY OCCUR.

10. Indemnification

You will defend, indemnify, and hold harmless us, our affiliates, and our personnel, from and against any third-party claims, losses, and expenses (including attorneys’ fees) arising from or relating to Your Bot, including Bot responses, your use of data received through the APIs, and your violation of these Terms or applicable law.

11. General Legal Terms

These Terms do not create any third party beneficiary rights or any agency, partnership, or joint venture. Nothing in the Terms will limit either party's ability to seek injunctive relief. We are not liable for failure or delay in performance to the extent caused by circumstances beyond our reasonable control. If it turns out that a particular term is not enforceable, this will not affect any other terms. The Terms are the entire agreement between you and Quora relating to its subject and supersede any prior or contemporaneous agreements on that subject.

You may not assign, sublicense, or delegate any of your rights or obligations under the Terms (including any sale, license, or other transfer of ownership of Your Bot) to any third party without our prior written consent. Any assignment, sublicense, or delegation in violation of this provision is null and void. Any change of control or material ownership of you is hereby deemed an assignment. These Terms are non-exclusive. You acknowledge that Quora may develop products or services that may compete with, or are similar to, Your Bots or any other products or services.

We may change these Terms from time to time, with or without prior notice to you. If you continue to access or use the APIs after the changes have taken effect, it means that you agree to the changes. If you do not agree, you must stop using the APIs.
